Scope of application: 1.a. Article 1
 
This Directive, as part of a plan to increase energy efficiency in the European Community, sets forth the efficiency requirements applicable to new hot water boilers (hereinafter referred to as "boilers") with liquid or gaseous fuel and rated output power between 4kW and 400kW.
 
Article 2
 
For the purposes of this directive:
 
(A) Boiler: a combination of a boiler body and a burner for transferring the heat released by the combustion into the water;
 
(B) Gas appliances:
 
• boiler body with burner;
 
• Burner mounted on the boiler body.
 
(C) Rated effective output (in kW): Maximum heat output that is specified and guaranteed by the manufacturer and available during continuous operation and meets the manufacturer's specified effective efficiency;
 
(D) Effective efficiency (in%): The ratio of the heat output delivered to boiler water to the product of the net calorific value at constant fuel pressure and the amount of fuel consumed per unit time:
 
(E) Partially loaded (in%): Ratio of the effective output of a boiler operating intermittently or less than the rated effective output to the rated effective output;
 
(F) The average boiler water temperature: the average temperature at the boiler inlet and outlet;
 
(G) Standard boilers: Boilers designed to limit average water temperature;
 
(H) Household water heaters: Boilers that supply water to a central heating system and are installed in the fireplace groove as part of a domestic water heater / gas combustion system;
 
(I) Low-temperature boilers: Boilers capable of continuously providing hot water at 35 ° C to 40 ° C and in some cases may condense, including condensing boilers using liquid fuels;
 
(j) Boilers installed in dwelling space: Boilers with a rated effective output of less than 37 kW for the purpose of supplying heat to the part of the dwelling where the boilers are installed, by means of thermal radiation, heat radiation from the boiler enclosure with open expansion chambers , The use of natural circulation of hot water supply; this boiler shell should be clearly indicated: they must be installed in the living space.
 
Article 3
 
1. This Directive does not apply to the following boilers or equipment:
 
- hot water boilers that can burn different fuels, including solid fuels;
 
- Fast hot water burning equipment;
 
- The characteristics of the fuel being burned are significantly different from the boilers normally sold for liquid or gaseous fuels (industrial waste gas, biogas, etc.)
 
- Mainly used for the heating of the houses in which it is located and for cooking utensils and gas appliances serving as auxiliary functions for the supply of hot water for central heating and for the supply of domestic hot water;
 
- rated output of less than 6kW, the use of natural circulation and only for the production of domestic hot water storage gas appliances;
 
- Boilers made on a single-use basis.
 
2. For dual-function boilers, which have both heating and hot water supply functions, the efficiency requirements referred to in paragraph 1 of Article 5 of this Directive relate only to the heating function.
 
Article 4
 
1. Unless otherwise provided in the EC Treaty or other Directive or Community Article, each Member shall not prohibit, restrict or obstruct, in its territory, the CE mark complying with the provisions of this Directive and affixing the provisions of Article 7 of this Directive to indicate compliance with this All articles of the Directive, including gas appliances and boilers conforming to the conformity assessment procedures of Articles 7 and 8, are placed on the market or delivered for use.
 
2. Each Member shall take all necessary measures to ensure that the boiler only meets the efficiency requirements of paragraph 1 of Article 5 of this Directive and the conditions of delivery specified by Member States in accordance with local climatic conditions and the energy and occupancy characteristics of the building Can put into use.
 
3. However, from the date of the passing of this AD, member States that have installed domestic water heaters and / or boilers in their living spaces extensively should be allowed to continue their operation, provided that they are rated at 30% The efficiency under load shall not be less than 4% of the requirements of the standard boiler provisions in paragraph 1 of Article 5 of this Directive.
 
4. The results of the implementation referred to in paragraphs 2 and 3 above shall be regularly reviewed by the Commission of the European Communities and analyzed in the report submitted in accordance with article 10 of this directive. To this end, Member States should communicate to the Council of the European Communities any information necessary for the proposed amendment to ensure the energy efficiency and free circulation of boilers in the European Community, to the Council of the European Communities.
 
5. (a) If the boiler must otherwise execute other directives and the directives require the CE marking to be affixed, the sign indicates that the boiler may also be presumed to comply with the terms of these other directives.
 
(B) However, if one or more of these directives allow the manufacturer to choose which option to pursue during the transitional phase, the CE mark shall indicate that only the directives adopted by the manufacturer are applicable. In such cases, details of the applicable directives published in the Official Journal of the European Communities must be given in the documents, circulars and manuals required by the Directive and be attached to the boiler.
 
Article 5
 
1. The boiler must comply with the following effective efficiency requirements:
 
- rated output, ie at rated output Pn in kW, operating at an average water temperature of 70 ° C; and
 
Partial load, ie at 30% load, the average boiler temperature varies with boiler type.

2. Coordination standards mandated by the Commission of the European Communities in accordance with Directive 83/189 / EEC and Directive 88/182 / EEC concerning the requirements of this Directive shall provide in particular for validation methods valid for production and measurement. The efficiency level must include a modest tolerance.
 
Article 6
 
1. In accordance with the procedure set forth in Article 7 of this Directive, each Member State may decide to adopt a specific marking system that can be used to clearly define the energy efficiency of a boiler.
 
The system shall be suitable for boilers which are more efficient than the standard boilers required by paragraph 1 of Article 5 of this Directive.
 
If the efficiency of a boiler at rated output and part load is greater than or equal to that of a standard boiler, the boiler shall be awarded an asterisk "★" mark as specified in point 2 of appendix I.
 
The boiler will be given a "★★" mark with two asterisks if the efficiency at rated output and part load is more than three percentage points above the value associated with a standard boiler.
 
As specified in Appendix II, an additional asterisk ("★") mark will be allowed for every 3% increase in efficiency at rated output and part load.
 
2. Member States shall not allow the use of any other mark that is likely to be confused with the mark mentioned in paragraph 1 of this article.
 
Article 7
 
1. Each Member State shall consider those boilers that meet the harmonized standards (whose numbers have been published in the official journal of the European Communities and to which member countries have issued the national standard number converted in accordance with these harmonized standards) as being in compliance with paragraph 5 Article 1 of the basic efficiency requirements. Such boilers must be affixed with the CE mark as described in point 1 of appendix I and must be accompanied by an EC declaration of conformity.
 
2. The mass production of boilers should be qualified as follows:
 
(A) Verify the efficiency of a boiler type in accordance with Mode B in Appendix III;
 
(B) Declare the approved type in accordance with Mode C, Mode D or Mode E as described in Appendix IV.
 
For gas-fired boilers, the conformity assessment procedures for efficiency shall be conformity assessment procedures in accordance with the safety requirements of Directive 90/396 / EEC.
 
3. When gas appliances sold separately are placed on the market, they must be affixed with the CE mark and accompanied by a declaration of conformity. The parameters identified in the declaration of conformity will enable the gas appliance to be, after assembly, up to the requirements of paragraph 1 of Article 5 of this Directive Effective efficiency level.
 
4. In compliance with the requirements of this AD, other provisions of the CE marking and the inscriptions specified in Appendix I shall be affixed to the boiler in a clear, legible and easily applied manner. It is forbidden to affix a sign on the boiler that may cause third parties to misunderstand the meaning and form of the CE mark. Any other markings may be affixed to boilers and gas appliances as long as they do not reduce the visibility and clarity of the CE mark.
 
5. (a) If the Member State confirms that the CE mark has been improperly affixed, the manufacturer or its authorized representative in the European Community shall be responsible for bringing the product into conformity with the provisions of the relevant CE mark and in accordance with the conditions set by the Member State Suspension of such violations.
 
(B) If not, Member States must take all appropriate measures to prevent, restrict, or prohibit the placing of the product on the market, or pledge to withdraw it from the market and notify the Commission of the European Communities and other member States.
 
Article 8
 
1. Each Member shall notify the Commission of the European Communities and other member States of the institutions designated for the implementation of the procedure referred to in Article 7 of this Directive, the specific tasks assigned to these bodies and the numbers previously assigned to them by the Commission of the European Communities. The Commission of the European Communities shall publish the name, serial number and list of designated missions of the designated agencies. The Commission of the European Communities should ensure that the list is updated at all times.
 
2. In designating such institutions, Member States shall implement the minimum requirements set out in Appendix V. Institutions that meet the criteria of the corresponding harmonized standard shall be considered as complying with the criteria of Appendix V.
 
3. If a Member State discovers that an institution designated by it no longer meets the criteria set forth in paragraph 2 of this article, its designation must be withdrawn.
 
The Member State shall immediately and immediately notify its other member states and the Commission of the European Communities of its decision, and withdraw its designation of the institution.
 
Article 9
 
1. Member States shall adopt and promulgate, by January 1, 1993, the terms necessary for the implementation of this Directive and notify the Commission of the European Communities immediately. The above provisions shall come into force on January 1, 1994.
 
In adopting the above provisions, each Member State shall include the serial number of this AD or the serial number of this AD when it is officially released.
 
Member States should specify the method of giving a number.
 
2. Each Member State shall, on or before December 31, 1997, allow any gas appliance complying with the existing national regulations and systems in its territory to be put on the market and deliver it from the date of the passing of this AD.
 
Article 10
 
Three years after the operation of this Directive, the Commission shall submit to the European Parliament and the Council a report on the implementation of the results. The report should be accompanied by a proposal to make any changes to this Directive based on the results of the implementation and technical progress.
